• Enrex Energy did not leave consumers signed contracts to sell electricity or gas at their homes.
• This practice made it difficult for consumers to accurately review the terms of the contract and possibly withdraw from it.
• The President of the Office of Competition and Consumer Protection Tomasz Chróstny imposed a fine PLN 200,000 on Enrex Energy.

Enrex Energy from Katowice is an electricity and gas trader. Most of the contracts were made in consumers' homes, which is an off-site location. The Office of Competition and Consumer Protection received complaints that the company representatives did not leave signed copies of documents to the consumers.

"I did not receive my copy of the contract or the withdrawal form at the time. So I couldn't read it in peace after the sales reps left. I was assured that the documents would be mailed to me. I became aware of the change in supplier when I received the charge slips (...)"

"He didn't leave me any documents. When my wife called the Energy hotline, she found out that we were probably scammed. I couldn't rescind the contract in time because I didn't know with whom it was concluded."

Under the law, a trader is required to deliver an off-site contract to the consumer. - The consumer needs to be able to read the terms and conditions of the agreement in detail and refer to them later in case of any doubts - stresses Tomasz Chróstny, President of UOKiK.  - Enrex Energy's failure to issue these documents also made it difficult for consumers to exercise their right to withdraw within 14 days from an off-site contract because they may not have known with whom they signed the contract and to what address to send the withdrawal notice , he adds.

The President of UOKiK imposed on Enrex Energy a financial penalty of PLN 200,000 (PLN 200,310) for the practice of infringing collective consumer interests. The company must also announce the decision of the President of the Office on its website and notify persons with whom it has concluded contracts for the sale of electricity or gas between 1 August 2019 and 1 March 2020 (which is the duration of the challenged practice). From the content of these letters, aggrieved consumers will learn that once the decision becomes final, they will be able to refer to it in court when pursuing claims against Enrex Energy.

Ban on concluding electricity and gas contracts in consumers' homes

We would like to remind you that as of 3 July 2021 it is forbidden to conclude contracts for electricity and gas outside company's business premises. All electricity and gas contracts signed at consumers' homes after that date shall be void under the law.
